SALINAS, Calif. -- A judge from outside of Monterey County was named Friday to preside over the trial of former Monterey County Elections Registrar Tony Anchundo.Anchundo is accused of embezzling thousands of dollars from the county.Last month, all of the judges in Monterey County recused themselves from the case, citing their frequent interaction with him as a potential conflict of interest.
Judge James Cadle of San Joaquin County will preside over the case.Anchundo's attorneys have filed two motions objecting to Cadle's appointment. They attorneys said they object to all of the Monterey County judges recusing themselves. They also argued that if the judges can recuse themselves because of frequent interaction with Anchundo, the prosecutors should do the same.If that happened, it would require the state attorney general to take over prosecution of the case. The next hearing in the case is scheduled for Dec. 20.
