SALINAS, Calif. -- Attorneys for the state and attorneys opposed to plans for spraying to eradicate the light brown apple moth were in court Thursday morning, but the judge did not make a decision. If the judge does not uphold the injunction, the spraying could resume as early as the middle of next week. What the judge wants the state to do is have a plan to track people's complaints about illness and a way to analyze it.
The state said they do have monitoring in place for the application of the pheromone and that the ingredients in the spray are safe and there are no hidden ingredients. However, the state still hasn't put a program in place that would monitor the effects of the spraying on people. The hearing began at 9 a.m. Thursday with attorneys for the opposition group Helping Our Peninsula's Environment (HOPE) and California's deputy attorney general taking a little less than two hours to present their arguments for and against the spraying.During the session, Judge Robert O'Farrell's focus was for the state to make a declaration that it would provide monitoring and analysis of the spraying while also ensuring concerned citizens will have a place to voice their concerns.
