Disability Lawsuits Filed Against Carmel Restaurants

CARMEL, Calif. -- A man who is becoming known for filing disability lawsuits against small businesses across California is now taking aim at Carmel-By-The-Sea.Jarek Molski, 34, is the same man who caused Roy's Restaurant in Salinas to shut down at the end of the summer. He sued the owners, claiming the building was not handicapped accessible. The owners couldn't afford to pay a settlement or fight the lawsuit.
And what happened at Roy's is now on the minds of some businesses in Carmel. Eight Carmel restaurants are being sued for $1.5 million each. At least one of the restaurants may be forced to file for bankruptcy. The lawsuits target some of Carmel's most popular restaurants, including Katy's Place, where locals and tourists mix over breakfast and lunch. Casanova -- one of Carmel's most well-known restaurants -- also faces a lawsuit. Its owners have already fixed the problems cited by raising a toilet an inch and a half and lowering a mirror a couple of inches. But fixing the problem isn't making the Casanova's lawsuit go away. "It's just a demand for money based on your ability to pay," said Casanova owner Gastonn Georis. "And they'll just try to pull out of you whatever they can by saying, if you don't accept it, it's going to cost you more every day." People who frequent Carmel restaurants will recognize the names of the other places being sued, including Jack London's, A.W. Shucks, the Carmel Bakery, Robata, Lugano and Friar Tucks. The restaurant owners are getting together to figure out their next steps and to look for help from the city in complying with guidelines. They are also looking for help from a local judge to put an end to all of the lawsuits filed against Carmel businesses. Recently, a district court judge in Central California banned the man who files the lawsuits from filing any more cases without permission of the court.
